High Court ASBO Challenge Settled

On 28th June 2012 the High Court approved the settlement of an appeal by way of case stated in a challenge to an ASBO on the ground that the local authority applicant had failed to comply with its consultation duties under s22 of the Children Act 1989 and therefore the order was unlawful. The compromise of the appeal followed from an earlier application to discharge the ASBO in the magistrates court where the local authority acknowledged that the ASBO "should never have been made". The Appellant was represented by Russell James and Owen Lawton Solicitors.
